What the municipal rules say

Ladysmith allows up to three or four dwellings on qualifying small lots outside infrastructure extension areas, but some mapped areas retain earlier density caps.

What applies locally

Ladysmith adopted its small-scale housing amendment (Bylaw 2186) on June 27, 2024. The town states that otherwise eligible lots outside extension areas may generally provide up to three units if under 280 m² and up to four units from 280 m² through 4,050 m², subject to siting, servicing and permits. Its December 2024 staff report says the Province approved most, but not all, requested infrastructure extensions in September 2024.

Important limits and exceptions

In approved infrastructure extension areas, the previous pre-June-27-2024 density cap may still control until the specified expiry or upgrades. The Town’s SSMUH webpage retains older text saying its infrastructure-extension application was still under provincial review; do not infer that an extension is approved, still active or expired from that stale text alone. Do not treat that outdated status text as proof all extension areas are unapproved or assume a mapped parcel belongs to an approved area without checking the ministry instrument and current municipal map.

Before work begins: confirm the lot’s actual zoning, mapped overlays, legal parcel characteristics, servicing and applicable building permit conditions with the municipality.

Property confirmation still required: This is an informational municipality guide, not a zoning certificate or construction approval. Confirm parcel zoning, overlays, current amendments, servicing and permit details directly with the municipality.

Municipal guidance is a starting point, not a property approval. This page does not calculate a legal unit count for an individual lot.

V69.61 targeted primary-source review · October 12, 2026: The Town guidance identifies three/four-unit paths outside provincial infrastructure extension areas; within an approved extension area, pre-June-27-2024 density caps may continue until upgrade or expiry. Official municipal record ↗ Not yet verified: The webpage contains stale language saying the Province is still reviewing applications; verify ministerial approvals and mapped extension boundaries for each parcel. No comprehensive current-by-law signoff or parcel approval is claimed.
